Terms of Sale

1. Scope

These Terms of Sale govern the sale of products by RANK SAS, a French simplified joint-stock company with share capital of €1,000, having its registered office at 63 bis Boulevard de Metz, 35700 Rennes, France, registered under SIREN 934 234 949 RCS Rennes ("POPSTRAP", "we", "us"), to any individual consumer ("you", the "Customer") through the Website popstrap.shop.

By placing an order, you confirm that you have read, understood and accepted these Terms in full.

2. Products

POPSTRAP sells limited-edition bracelets and accessories distributed through numbered "drops". Each drop is a closed edition, sold once, produced in limited quantities, and not restocked.

Photos and visuals are non-contractual. Despite our care in describing and photographing each product, slight variations in colour, finish, texture, weave, slider machining and final assembly are inherent to handmade and small-batch production and are not considered defects.

3. Orders, capacity and pre-orders

Drops operate on a pre-order basis. Your card may be authorised at checkout and captured on drop close (the day production locks at our atelier). Stock figures shown on the Website are indicative; the order is definitive only upon the email confirmation we send after payment capture.

We reserve the right, at our reasonable discretion, to refuse or cancel an order in case of suspected fraud, payment irregularities, breach of these Terms, abnormal order quantities, manifest pricing or stock errors, or any other legitimate reason. In such cases, any sums already debited will be refunded without compensation.

4. Prices

Prices are shown in euros, including all applicable French VAT, unless your country's VAT settings indicate otherwise at checkout. Shipping fees, if any, are displayed before order confirmation.

Customs duties, import VAT, and any local taxes applicable in countries outside the European Union are not included in the price and are payable by the Customer at delivery.

5. Payment

Payment is by credit/debit card or by any other payment method offered at checkout, processed by our payment providers. We never store full card details on our servers. We may refuse to ship an order if payment is not received in full or is later contested.

6. Delivery

Production begins after the relevant drop closes. Delivery times are estimates, not guarantees:

  • typical estimate: 4 to 14 business days after the order is shipped;
  • actual delivery times may vary depending on the destination, the carrier, customs clearance, public holidays, weather, force majeure and other external factors beyond our control.

The maximum delivery time, in any case, will not exceed thirty (30) days after the order is shipped, unless you have agreed otherwise. If we fail to deliver within this maximum time, you may request shipment within an additional reasonable period; if delivery has not occurred at the expiry of that additional period, you may cancel the affected portion of the order pursuant to Article L216-2 of the French Consumer Code.

Risk of loss and damage transfers to you at the moment you (or a designated third party other than the carrier) take physical possession of the goods.

7. Right of withdrawal (14 days)

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a period of 14 calendar days from receipt of the goods to withdraw from the contract, without giving any reason.

To exercise your right of withdrawal, you must notify us of your decision by an unambiguous written statement (e.g., email to contact@popstrap.shop) before the 14-day period expires. You may use the model withdrawal form below.

Conditions:

  • the product must be returned in its original condition: unworn, unwashed, undamaged, with all original packaging, tags and accessories;
  • any product showing signs of wear, soiling, alteration, missing packaging or tags will be refused and returned to you at your expense;
  • return shipping costs are borne by the Customer, pursuant to Article L221-23 of the French Consumer Code;
  • the product must be returned within 14 days of notifying your withdrawal.

If conditions are met, we will refund the price paid for the product (excluding return shipping) within 14 days of receiving the returned goods or, if earlier, receiving proof of dispatch, using the same payment method used for the original purchase. We may withhold the refund until we have received the goods or proof of return.

The right of withdrawal does not apply to goods that, under Article L221-28 of the French Consumer Code, are excluded, including products made to your specifications or clearly personalised, and goods that have been unsealed where return is excluded for hygiene reasons.

Beyond the 14-day legal withdrawal period, we do not accept returns and no refund will be granted, except where required by the legal warranties set out below.

8. Legal warranties

All products benefit from the legal warranty of conformity (Articles L217-3 to L217-20 of the French Consumer Code, period of 2 years from delivery) and from the warranty against hidden defects (Articles 1641 to 1648 of the French Civil Code, 2 years from discovery of the defect).

Under the legal warranty of conformity, you may choose between repair or replacement, subject to the cost conditions provided for in Article L217-12 of the French Consumer Code. You are exempt from proving the existence of the lack of conformity during the 24 months following delivery (or the duration provided by applicable law).

To make a claim under these warranties, please write to contact@popstrap.shop describing the issue and including order details and photos.

POPSTRAP Lifetime Repair — In addition to legal warranties, and as a goodwill gesture, we offer to repair workmanship defects (e.g., frayed cord, stuck slider) at our atelier for the lifetime of the product, free of charge. The Customer ships the product at their own cost; we cover the return. This commercial warranty is offered in addition to, and does not replace, the legal warranties.

9. Liability

Our liability is engaged only for direct, foreseeable and certain damages directly caused by us, and is in any event limited, to the maximum extent permitted by law, to the amount actually paid by the Customer for the order giving rise to the dispute. We are not liable for indirect or consequential damages such as loss of profits, loss of opportunity, loss of data, or reputational damage.

We are not liable for any failure to perform that is due to force majeure (Article 1218 of the French Civil Code), or to the fault of a third party (carrier, payment provider, public authority), or to your own fault (incorrect address, refusal of delivery, non-payment of customs).

10. Personal data

11. Mediation and dispute resolution

Any complaint should first be addressed in writing to contact@popstrap.shop. We will do our best to resolve disputes amicably.

In accordance with Articles L611-1 et seq. of the French Consumer Code, the Customer may, after attempting a written complaint with us, refer the dispute free of charge to a consumer mediator. The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

12. Governing law and jurisdiction

These Terms of Sale are governed by French law. Any dispute that cannot be resolved amicably or through mediation shall be subject to the competent courts under the rules of jurisdiction of the French Code of Civil Procedure. As a consumer, you may bring proceedings before the courts of your place of residence, of our registered office, or of the place where the product was delivered.

13. Updates

We may amend these Terms of Sale from time to time. The version applicable to your order is the one in force at the moment you place the order.
